Service conditions
Subject of the agreement: recovery and restoration of information stored on storage media.
- The CLIENT engages KÜRT to evaluate and recover data from CLIENT's storage media in accordance with the conditions of this Contract and the detailed conditions laid down in the data sheet completed by the CLIENT and enclosed to this Contract. The CLIENT shall truthfully complete the data sheet. Costs arising - during data recovery - from errors or omissions in the data sheet shall be charged on the CLIENT.
- In case of storage unit evaluation and data recovery from hard disk,tape and RAID (NORMAL and PREMIUM diagnosis), Flash memory and magnetic tape, KÜRT shall, according to the preliminary service package selection, examine the storage unit, and prepare an expert evaluation and quotation, containing the technical conditions of the media, the feasibility of recovery, the expected price, and completion date.
- In case of STANDARD data recovery from hard disk or RAID, KÜRT shall provide a quotation within an hour after receiving the storage unit, containing the expected price of and completion date of the recovery. In such cases no expert evaluation is prepared.
- In case of CD, DVD, diskette or zip disk, the CLIENT may order data recovery without diagnostic evaluation at fixed prices listed on KÜRT's web page.
- The price of the 24-hour recovery - Urgent data recovery - is determined by KÜRT in each individual case. In case of unsuccessful Urgent Recovery, 20% of the price shall be paid by the CLIENT.
- Based on the quotation, the CLIENT may order data recovery or decline it. The expected duration of the recovery laid down in the quotation will start as of the date of the order of data recovery by the CLIENT. If the recovery is not fully completed by the given date, the CLIENT may decide whether to keep the order or decline it.
- KÜRT considers data recovery finished when the restored data are complete, and the CLIENT is notified over the telephone, fax, mail (e-mail) or the web page of the on-line electronic customer service.
- The CLIENT shall be aware that, if he/she orders recovery based on the evaluation, and then declines it after all,he/she may do so after paying the price of recovery.
- KÜRT is entitled to charge the price if the CLIENT insists on ordering recovery against expert evaluation stating that recovery attempt is not recommended due to severe data loss.
- In case of unsuccessful recovery, KÜRT shall not charge the price of recovery (with the exception of Urgent data recovery, see point (5) of this Contract).
- Should disputes regarding the success of recovery arise between KÜRT and the CLIENT, the parties shall make an effort to reach a mutual agreement.
- KÜRT shall guarantee the confidentiality of the CLIENT’s data. KÜRT shall only use the information and data coming in its possession during the job covered in this Contract in order to achieve the subject of this agreement KÜRT shall not disclose or publicize such information.
- KÜRT shall prepare a security backup copy of the CLIENT’s data, safekeeping it for 14 days, and then destroy it, unless the CLIENT requests otherwise. Simultaneously to handing back the original storage unit, KÜRT shall destroy existing backup copies. After this, the CLIENT shall have no further claims regarding this data recovery job.
- Parts of this agreement: data sheet containing information about the damaged storage media, KÜRT’s current price list, and the document containing KÜRT’s general service conditions.
- In other issues, this agreement is subject to the authority of the Civil Legal Code.
